The Punjab and Haryana High Court has set aside the notification wherein Chandigarh Mayoral Election was scheduled for January 24 and directed to re-schedule the polls after January 29. Mayor Kuldeep Kumar to continue tenure of the present mayor office till then. 

Justice Sureshwar Thakur and Justice Vikas Suri was hearing the petition filed by Chandigarh Mayor Kuldeep Kumar (AAP), who sought to continue until February 20, the date when he took over last year following the legal battle which reached the Supreme Court.

The plea was argued by Senior Advocate Gurminder Singh who highlighted the last year's fiasco wherein the Supreme Court found that the ballot paper was defaced by the returning officer. Consequently the General House of Municipal Corporation, recognising such shortcomings in the voting process passed a table agenda to alter the manner in which elections are conducted.

The plea sought the quashing of the election schedule, which was set for January 24, on the grounds that it was premature, as it was argued that the one-year period would commence from February 23, following the Supreme Court's direction.

Senior Advocate Gurminder Singh had also sought quashing of letter whereby the Deputy Commissioner had decided to conduct the election without considering the table resolution to conduct the mayoral poll by show of hands instead of ballot paper. On this the Court asked the Administration to consider the same, in the light of fairness in the election procedure.
