Rajasthan High Court Directs Legal Services Authority To Arrange Treatment For Convict's Daughter, Declines Repeated Parole

While dismissing a convict's plea for emergent parole for his daughter's treatment at AIIMS, the Rajasthan High Court directed the District Legal Service Authority, Sirhoi, to make suitable arrangement for her treatment at Sirohi or at appropriate centre.
The division bench of Justice Vinit Kumar Mathur and Justice Chandra Shekhar Sharma observed that considering the fact that petitioner's daughter was suffering from a psychiatric disorder, she would require regular treatment. However, the petitioner could not be allowed emergent parole at regular intervals.
It was the case of the petitioner that there was no able member in this family who could get his daughter's treatment done at AIIMS, Jodhpur. Hence, he had filed for emergent parole.
This was opposed by the State on the ground that the daughter's ailment was such that required regular treatment, and every time the petitioner could not be granted emergent parole for that purpose.
The Court agreed with the submission of the State and observed,
“…there is no male member in the family, who can take care of the treatment of the petitioner's daughter. At the same time, the convict-petitioner cannot be allowed to file emergent parole every second month or at a regular interval, therefore, in the considered opinion of this Court, the convict petitioner is directed to take the services of District Legal Service Authority.”
In this background, the DLSA, Sirohi was directed to make suitable arrangements for the daughter's treatment at Sirohi or at appropriate centre. In this regard, the Court further stated that if sought, requisite help shall be provided by RLSA or DLSA, Jodhpur.
Accordingly, the petition was disposed of.
