While rejecting bail in an alleged cyber crime case, the Rajasthan High Court observed that the crime was a result of complainant's greed and directed the Superintendent of Police to recover the cost of the investigation in the case from the complainant.

The bench of Justice Ravi Chirania opined that the reason behind successful commission of most of the cyber crimes was people's greed to earn unusual high returns, and to investigate the consequence of such greed, the State machinery had to be put into action.

“To investigate the consequences of such greed, the State has no other option, but to put its machinery into motion, however, precious public money cannot be allowed to be expended in investigating such offences which, prima facie have occurred due to greed of such persons.”

For context, the Court was hearing a bail application filed by the applicants who were accused being involved in cyber scams and taking almost Rs. 20 Lakhs from the respondent by alluring high returns on an SBI life insurance policy of around Rs. 2.5 Lakhs.

Considering the seriousness of the allegations, the Court rejected the bail applications. However, it was observed that the respondent was a government teacher who was earning more than Rs. 80,000 per month. And the reason he fell for the trap was because of his greed since he wanted very high returns on his life insurance policy.

The Court observed that, to investigate the consequences of his uncontrolled greed, the State machinery was required to be put into action. However, public money could not be spent on investigating the offences that prima facie happened due to such greed.

In this background, the Court directed the concerned SP to calculate the cost incurred in investigation of the present case, and recover the same from the complainant, to be deposited in the account opened from the welfare of the police personnel by the DGP, Rajasthan.
