Sikkim High Court Initiates Suo Motu PIL To Examine State's Preparedness For Climate-Related Disasters
The Sikkim High Court has initiated a suo motu public interest litigation to examine whether the State has adequate institutional mechanisms to anticipate, mitigate, and respond to climate-related disasters.
The petition stated,
"Climate justice is, therefore, not merely a response to casualties after a-disaster. It is also a constitutional commitment to anticipate risk, prevent avoidable harm and build resilience before disaster strikes.It requires a shift from a purely reactive model of disaster management to an anticipatory and participatory model of climate governance".
The bench of Chief Justice A. Muhamed Mustaque took note of the reports published in the Sikkim Express on September 6 and 7, 2026.
The Chief Justice required the State to anticipate and be prepared and therefore directed the State to examine existing practices relating to building engineering, land-use regulation, spatial planning, slope management, drainage, road construction, settlement planning and rehabilitation in ecologically and geologically fragile areas.
The petition used frequent landslides as an example to demonstrate that such climate-related disasters compel families to leave their homes and seek temporary shelter in rehabilitation centres or community facilities. The petition stated that such displacement raises questions not only of management but also of dignity, livelihood, habitation, continuity of community life, and access to basic needs.
The bench also took serious note of the Glacial Lake Outburst Flood of 2023, which devastated the area. The bench noted that lessons from such a catastrophe showed that post-disaster relief was not sufficient and that there is a need for a broader framework of "anticipatory climate resilience".
Thus, the court proposed that the State and other stakeholders identify vulnerable areas, early warning, disaster preparedness, climate-resilient construction, spatial planning, protection of vulnerable communities, rehabilitation, and long-term climate resilience.
Therefore, the bench directed the issuance of notice to all stakeholders, vulnerable communities, and experts.
