Court says she will conclude hearing the recusal applications today.
Hegde: It is not necessary to look at it from personal point of view of judge or litigant. It is even on subject matter.
Hegde: The point also is that after an apprehension is raised, and if your ladyship is satisfied that it is reasonable, the question is is there a necessity to go ahead?… In this court, it is not as if there are no other judges to whom the matter can be sent to if there were a recusal.
Hegde: My endeavour is to say that it is no unreasonable. The point of view in these matters are not that of a judge but of a man fighting for this freedom.
Hegde: Your ladyships is asked to reconsider or revise what another court has held. Your ladyship is not sitting in appeal but in revision. Would a litigant who has all this said about him and who has said exactly the contrary…. The proverb would be “once bitten twice shy.”
Hegde: Your ladyship has domain knowledge of the case. I am not holding it as a charge. I am saying sometimes its the judicial mind when it is most certain of things, thats a moment which requires the judicial mind to step back. Having said so much, it is highly unlikely….
