The Supreme Court today(October 9) issued notice to the State of Karnataka's plea challenging the Karnataka High Court's order staying the conviction of former Congress MLA Vinay Kulkarni for the murder of BJP Zilla Panchayat member Yogesh Goudar in 2016.

Recently, the High Court stayed the former MLA's conviction until his appeal challenging the conviction is disposed of. Additionally, the High Court had granted him bail subject to certain conditions. It may be noted that the High Court also suspended the sentence of the other accused–Chandrashekhar Indi @ Chandu Mama and Channakeshava B Tingarikar.

Today, a bench comprising Justice Prashant Kumar Mishra and Justice Shree Chandrashekhar issued notice on the State's plea challenging the suspension of the conviction and sentence of not just the former MLA, but also Chandrashekhar and Channakeshava.

The Special Court had convicted Kulkarni and others in April this year for the murder of Yogesh Goudar, a zilla panchayat member of the BJP from Hebballi constituency. He was murdered by an armed gang at his gym in Saptapur in Dharwad in 2016. An FIR was registered with the Dharwad Sub-Urban Police Station at the instance of the deceased's wife. The Dharwad Police, subsequent to his murder, arrested six persons and charge-sheeted them for murder. The probe was later transferred to CBI.
