Dhruv Mehta: your lordship has captured what i wanted to say.
Mehta refers to impugned communication of June 16.
Court: you are questioning nature of power bh saying it is not emergency situation. You are saying info can be blocked not the app. Third is application of mind by secretary and fourth is propotionality
Dhruv Mehta refers to provision: satisfaction of secretary is very important…he can issue direction with reasons in writing…this is power. There has to be application of mind on material. All this must find mention in order itself.
Dhruv Mehta: final order is a confirmation order. though my lord is right it was after giving an opportunity
Court: it is an order. Confirmation and reversal depends on facts of each case.
It is an independent requirement. It may or may not get confirmed. There is a post decisional hearing…opportunity has been given: court
Court asks petitioner to address arguments on the final order
Sr adv Dhruv Mehta: order suffers from legal infirmity. It merely confirms the interim direction.
SGI: Page 50 of my reply, they were called heard. Findings are recorded by review committee chaired by cabinet secretary
We have filed our response: SGI
