“Hungry, Tired, Physically Incapacitated To Dictate Judgment”: Allahabad High Court Judge After Hearing Cases Till 7.10 PM

The judge sat beyond the regular working hours to hear a matter within the deadline fixed by the Supreme Court

Recently, the Lucknow Bench of the Allahabad High Court observed that due to tiredness, hunger and physical incapacity, it was unable to dictate the judgement in open Court in a matter expedited by the Supreme Court and therefore, the judgment was reserved.

Justice Subhash Vidyarthi observed,

Today there were 92 fresh matters, 101 regular matters, 39 fresh misc. applications and three matters listed in the additional/unlisted list-I, Il and III. Only fresh cases upto serial number 29 could be heard today. However, keeping in view the order passed by Hon'ble the Supreme Court hearing of this matter was commenced at 4.15 p.m. and it has concluded at 7.10 p.m.”

While reserving the judgment, he observed,

Since I am feeling hungry, tired and physically incapacitated to dictate the judgment, the judgment is reserved.”

The matter pertained to challenge to an order passed by the Debts Recovery Tribunal. The order was quashed and matter was remanded to the DRT for fresh consideration. Subsequently, the matter travelled to Supreme Court which set aside the earlier order of the High Court and directed that the matter be decided preferably within 6 months. Thereafter, the matter was relisted for hearing before the High Court.

The matter was adjourned twice. Thereafter, it was listed under the heading of "Hon'ble Supreme Court expedited matters". Since it was listed under the said heading, the Court called out and heard the matter after 4 pm, which is the official timing of the Courts to rise.
