The Bombay High Court on Tuesday (August 25) ordered the Maharashtra Food & Drugs Administration (FDA) to re-inspect the five eateries operating in the premises of Mumbai Cricket Association (MCA) and submit its report on whether their suspended licences could be revoked.

In its recent surprise inspections, the FDA had suspended the FSSAI licenses of Permit Room, Oriental Swing, Clubway & Pastry Counter, Mediterranean and Pavillion all operating in the Sharad Pawar Indoor Cricket Academy and Recreational Centre at the plush BKC area in Mumbai.

A division bench of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad noted the contention of senior advocate Vikram Nankani, who represented the MCA that all its premises are over 98% compliant now and thus the licence should not continue to be suspended.

Additional Government Pleader Priyabhushan Kakade, the Standing Counsel for FDA, however, sought time as the petitions were served to them late. He submitted that he would file an affidavit-in-reply to the petitions filed by the MCA. He also pointed out that the petitioners have the remedy to appeal the order of licence suspension before the FDA Chief.

The bench while agreeing to grant time to the FDA, however opined that if the petitioners are hygiene compliant now, they cannot be stopped from operating till the FDA Commissioner decides their appeal.

"You should be happy that your work is being lauded and you have achieved what you wanted that is they (MCA) are now claiming to be 98% (hygiene) compliant... But you cannot now let them wait till the appeal is decided," ACJ Ghuge told Kakade.

Thus, to balance the equities, the bench ordered the FDA to re-inspect the premises on Thursday afternoon. A report has been ordered to be submitted on Monday morning along with the affidavit of the FDA, indicating the hygiene compliance of the association.

As regards the tournaments to be organised in the MCA in the interregnum period, the bench has ordered the petitioners to only serve tea and coffee to the participants and not meals. The tea and coffee too has been ordered to be used from tea vending machines.

The matter will be heard again on August 31.
