The Calcutta High Court has declined to pass any orders in a plea seeking action against IPS Officer Ajay Pal Sharma, appointed as Police Observer by the Election Commission of India, for the ongoing West Bengal Assembly Elections 2026.

Sharma has been appointed as observer in the Diamond Harbour area of South 24 Parganas, which is also the Lok Sabha Constituency of Trinamool Congress Leader Abhishek Banerjee.

Justice Krishna Rao refused to entertain a verbal plea by an advocate, seeking sanction against Sharma who had allegedly breached the Model Code of Conduct (MCC) while issuing a 'warning' to TMC Candidate from the constituency Jahangir Khan, and his family, to refrain from alleged criminal activities.

Justice Rao clarified that the court would not be taking any action against poll duty officers till 29th April, which is the date for the conclusion of the second and final phase of the Bengal elections.

In the meantime, he stated that any aggrieved parties would be free to approach the Election Commission for intervention.
