Calcutta High Court To Hear PIL Challenging Removal Of All Loudspeakers From Mosques In West Bengal

The Calcutta High Court on Monday agreed to hear a Public Interest Litigation (PIL) challenging the alleged removal of loudspeakers from all mosques across West Bengal.

Senior Advocate Kalyan Bandopadhyay mentioned the matter before a Division Bench comprising Acting Chief Justice Tapabrata Chakraborty and Justice Atarup Banerjee, describing it as an “extremely urgent PIL”.

During the mentioning, Bandopadhyay submitted that the State Government was allegedly acting through oral instructions and that written directions concerning the removal of loudspeakers could not be found.

“This is an extremely urgent PIL. Now the government only uses oral instructions. You will never find any written instructions,” Bandopadhyay submitted.

He further alleged before the Bench that loudspeakers had been removed from all mosques in West Bengal. “All loudspeakers have been removed from all mosques in West Bengal,” he submitted.

Bandopadhyay also referred to an earlier judgment of a Division Bench in support of the proposed PIL. 

After hearing the submissions during mentioning, the Bench directed that the PIL be filed and the necessary service be completed.

“Your Lordship knows there is a judgment of the Division Bench,” Bandopadhyay submitted.

The Bench responded: “File it, we will keep it on the returnable day. Complete your service and come back.”

The matter is now scheduled to be heard on Thursday.
