The Delhi High Court has dismissed a plea filed by YouTuber Shyam Meera Singh to file documents regarding alleged victims of rape and their families to support his defence in the defamation suit filed by Isha Foundation, founded by spiritual leader Sadhguru Jaggi Vasudev.
Justice Subramonium Prasad dismissed the application, observing that it was premature.
The defamation suit was filed over an allegedly defamatory video uploaded by Singh on his YouTube channel against Vasudev and the foundation.
The video titled “Sadhguru EXPOSED: What's happening in Jaggi Vasudev's Ashram” was uploaded by Singh on his YouTube channel on February 24. He had shared it on his 'X' page with allegations suggesting that minors were being exploited in the Ashram.
In March, Justice Prasad had directed Singh to take down the video in question, observing that it was based on “unverified material” and that the title of the video was a clickbait to attract public attention.
Singh, in his application, sought a direction that the original documents containing actual identities of the persons allegedly sexually assaulted and their family members be filed in a sealed cover and not be made part of the public record.
He also sought a direction that Isha Foundation be served with the original documents with actual names but it shall not disclose the identities of the individuals that may lead to them being identified.
Rejecting the application, Justice Prasad said:
“Since the documents have not been filed, in the opinion of this Court, at this juncture, this application is premature and the same is accordingly dismissed.”
On May 30, a coordinate bench had passed a john doe order protecting the personality rights of Sadhguru, while restraining various rogue websites and unknown entities from misusing his personality traits through the use of Artificial Intelligence in any platform or medium.
Recently, the Court had asked Google LLC to make an endeavour to ensure that misleading and deepfake content infringing personality rights of Vasudev is removed and taken down through its technology.
