The Delhi High Court on Friday issued notice on a plea filed by producer of the proposed film “Kala Hiran – The Battle For Legacy”, seeking return of actor Salman Khan's suit to restrain the film's release, on the ground of lack of territorial jurisdiction.

Justice Tejas Karia sought response of the actor on Amit Jani's application filed under Order VII Rule 10 read with Section 151 of the Code of Civil Procedure.

The proposed movie is stated to be inspired by Khan's 1998 blackbuck poaching case.

Jani has argued that neither Khan nor the defendants reside or carry on business within Delhi's territorial jurisdiction.

He has contended that the mere accessibility of the film's teasers, posters and related publications across the country, including the national capital, cannot confer jurisdiction on the Delhi High Court.

Jani has contended that Khan resides in Mumbai, while the defendants are stated to reside or carry on business in Meerut, Uttar Pradesh.

According to the application, the plaint does not plead that the film or its promotional material specifically targeted an audience in Delhi or that Khan suffered any distinct injury there.

Further, Jani has opposed the relief seeking to restrain the film's release, arguing that an injunction against a completed cinematographic work is an extraordinary remedy and that a short teaser cannot provide a complete assessment of the film's context and overall impact.

Earlier this week, the Court had issued notice on the producer's application seeking stay of Khan's suit, arguing that substantially the same dispute is already pending before the Court in an earlier suit filed by Khan.

It was contended that the proceedings amount to parallel litigation concerning the same proposed film, promotional material and alleged infringement of Khan's personality or publicity rights.

The actor is represented by Senior Advocate Ravi Prakash, along with Advocates Nizam Pasha, Parag Khandhar, Chandrima Mitra, Tapan Radkar, Krishan Kumar, Zara Dhanbhoora, Charu Sharma.

The producer is represented through Advocates Pulkit Agarwal and Anubhav Lamba.

Last month, the producer had told Court that the film is not presently in a releasable state as its contents are yet to be certified by the Censor Board.
