The Delhi High Court on Tuesday issued notice on a plea filed by maker of proposed film “Kala Hiran: The Battle for Legacy” seeking to stay Bollywood actor Salman Khan's suit against release of the movie.

Justice Anup Jairam Bhambhani sought response of the actor who is seeking restraint on the release of the film.

The proposed movie is stated to be inspired by Khan's 1998 blackbuck poaching case.

The producer has filed an application arguing that substantially the same dispute is already pending before the Court in an earlier suit filed by Khan.

It has been contended that the proceedings amount to parallel litigation concerning the same proposed film, promotional material and alleged infringement of Khan's personality or publicity rights.

The producer submits that Khan had already instituted a suit concerning protection of his personality rights, in which an ex-parte ad-interim injunction was granted on December 11, 2025.

According to the producer, Khan subsequently moved a application seeking interim injunction specifically in respect of the same proposed film, which remains pending.

For context, on July 27, a coordinate bench had passed an ad-interim order restraining release of the teaser of the proposed film and directed takedown of 23 identified URLs.

The application contends that the core relief sought in the suit, i.e. restraining release, exhibition and dissemination of the proposed film and its teasers, is substantially the same relief already sought in the earlier proceedings.

It further claims that the cause of action in both proceedings arises from the same teasers, posters and publications, with no material distinction in the underlying facts.

It has been argued that allowing the suit to proceed simultaneously with the earlier case could result in two coordinate proceedings adjudicating the same underlying questions.

The plea accordingly seeks a stay of the trial of the suit, pending adjudication of the earlier suit. It also seeks a stay on further consideration of Khan's interim injunction application.

The actor is represented by Senior Advocate Ravi Prakash, along with Advocates Nizam Pasha, Parag Khandhar, Chandrima Mitra, Tapan Radkar, Krishan Kumar, Zara Dhanbhoora, Charu Sharma.

The producer is represented through Advocates Pulkit Agarwal, Sudhanshu Kaushesh, Anubhav Lamba, Sudhanshu Kumar, Rajat Kumar and Shubham.

Last month, the producer had told Court that the film is not presently in a releasable state as its contents are yet to be certified by the Censor Board.
