The Delhi High Court on Friday refused to pass urgent order permitting Jasir Bilal Wali, co-accused in the case concerning the recent Red Fort blast, to meet with his lawyer in the NIA headquarters.
Justice Swarana Kanta Sharma said that Wali failed to show any order passed by the trial court refusing him such relief and thus, a new procedure cannot be made by the Court.
“This (case) is not a special,” the judge remarked.
Justice Sharma also questioned the mere oral statement made by Wali's lawyer that his plea for legal meeting was rejected by the concerned trial court.
“Why should I trust you? Someone comes and says orally that it (application) was rejected…. Then everyone will come to us and say it was rejected,” the Court said, adding that the legal procedure stipulated has to be followed and cannot be changed for one accused.
The Court remanded the matter back to the trial court for adjudication tomorrow in accordance with law.
The NIA has alleged that Wani is an “active co-conspirator” of the “suicide bomber” Umar un Nabi. The blast claimed 15 lives and left various individuals injured.
In a statement, NIA said that Wani, a resident of Qazigund in Anantnag, was arrested in Srinagar on November 17.
The allegations are that he provided technical support for carrying out terror attacks by modifying drones and attempting to make rockets ahead of the bomb blast.
The statement termed Wani an active co-conspirator in the attack, who worked closely with the terrorist Umar un Nabi to plan the “terror carnage”.
