The Kerala High Court on Monday (September 28) issued notice to actress Ansiba Hassan in a plea filed by actor Lakshmi Priya and her husband seeking to quash a criminal initimidation case initiated against them based on Hassan's complaint.

Justice Jobin Sebastian was considering the plea preferred by Lakshmi Priya and husband Jayesh, who are arrayed as the 1st and 2nd accused in the crime registered before the Hill Palace Police Station. The 3rd accused in the case is a woman Sub-Inspector of Vanitha Cell, Tripunithura.

The FIR has been registered on the basis of a private complaint given by Hassan.

The allegation against is that the the 3rd accused SI called Hassan over to the Vanitha Cell for resolving the complaint filed by Lakshmi Priya, who had alleged that Hassan sent her messages disrupting her family life. It is further alleged that the accused SI made her wait in the Cell for around an hour on January 31 after which she was called into the cabin for questioning.

It also alleged that during the questioning, the woman officer threatened that Hassan would put in jail and criminal case would be taken against her. In the FIR, it is further alleged that Lakshmi Priya came there and questioned her in the presence of the SI and tried to force her to apologise to Jayesh on the phone. It is further alleged that the officer forced her to sign on documents stating that the issues between the actresses have been amicably settled.

They are accused of the offences punishable under Sections 127(2) [Wrongful Confinement], 198 [Public servant disobeying law with intent to cause injury], 199(a), 199(b) [Knowingly disobeying directions of law], 201 [Public servant framing an incorrect document with intent to cause injury], 217(b) [False information with intent to cause a public servant to misuse lawful power to the injury of another person], 336 [Forgery], 351 [Criminal intimidation], 61 [Criminal conspiracy] BNS and Section 116(b) of Kerala Police Act, 2011 [Illegal seizure, detention, search, or arrest causing annoyance without reasonable cause].

Contending that the allegations made are false, the petitioners have come before the High Court. According to the plea, Hassan dragged the disputes before the AMMA (Association of Malayalam Movie Artists) and that Hassan has made several allegations against other AMMA members.

"Her grievance is against A3, a Vanitha police officer, who officially intervened in a genuine complaint initiated by A1 [Lakshmi Priya]. From the averments it can be presumed that R2 [Hassan] had voluntarily participated in the proceedings and executed her signature in the settlement agreement. She is now carried away by certain developments, decisions and disciplinary actions taken in AMMA organization and carving out the present case without any legal basis," the plea further contends.

It is also pointed out that there was considerable delay of around 5 months in preferring the present complaint and that there is no specific culpable overt act made out against the petitioners.

Recently, Judicial First Class Magistrate IX (Ernakulam) had ordered a police probe against Lakshmi Priya and two CAN Channel representatives based on another private complaint preferred by Hassan accusing them of making sexually coloured remarks and circulating objectionable content against her.

Notably, the Judicial First Class Magistrate VIII, Ernakulam had directed the Kadavanthra police station to register FIR based on complaint by Ms. Hassan alleging Tini Tom of abusing her with words like 'Jihadi', etc.

The petition is moved by Advocates C.P. Udayabhanu and Navaneeth N. Nath.
