    The Judicial First Class Magistrate VIII, Ernakulam on Tuesday (June 30) directed the Kadavanthra police station to register a complaint based on Drishyam-actress Ansiba Hassan alleging Tini Tom of abusing her with words like 'Jihadi', etc.

    Smt. Kavya Soman, Magistrate passed the order yesterday in a private complaint filed by Ansiba before the Magistrate, following the refusal of the police to register a case against Tom.

    Perusing the police report, the Magistrate noted:

    "The report itself states that it has been revealed that the respondent had stated words like double-daddy syndrome, issue with DNA, jihadi, etc. against the complainant. According to the report, the respondent had used such words in a playful meaning and does not have any criminal intent.This shows that the report is incomplete and cannot be fully relied on to proceed further. Only after having a detailed investigation, a proper conclusion in this matter would arise. Whether there was criminal intent or not could only be determined after collection of entire evidence. Prima facie, there is element of cognizable offence committed against the complainant by the respondent and the same needs investigation...Hence, the complaint is forwarded to SHO Kadavanthra police station for investigation under Section 173(5) of BNSS."

    The Magistrate noted that the offences alleged in the complaint are those punishable under Sections 74, 75(iv), 79, 299 and 302 of BNS and Section 119(a) of Kerala Police Act.

    It was further noted that one of the witnesses, Neena Kurup, had given statement to police that at the AMMA office in Deshabhimani (Kaloor), Tom had stated to her comments that would attract offence punishable under Section 299 and 302 of BNS. Kurup had given statement that AMMA President Swetha Menon had told to her that Tom had stated similar facts to her also about Ansiba, it was noted.
