Kerala High Court Impleads NCB In Lawyer's Plea To Quash Case Alleging Threat To Intelligence Officer

The Kerala High Court on Friday (July 3) impleaded the Narcotics Control Bureau (NCB) as an additional respondent in the plea filed by a lawyer seeking to quash a criminal case accusing him of threatening and intimidating an Intelligence Officer.

Justice C.S. Dias allowed the petition filed by the petitioner, a 30-year-old practicing lawyer.

It had earlier granted the advocate interim protection by restricting the investigating officer from taking any coercive action. Yesterday, the interim order was extended by a week and the case was posted to July 10 (Friday) for further consideration.

The crime has been registered by the Ernakulam Town Police Station alleging commission of offences under Sections 351(2) [Criminal intimidation] and 224 [Threat of injury to public servant] of the Bharatiya Nyaya Sanhita based on the officer's private complaint.

The prosecution allegation is that the petitioner threatened the officer at the premises of the CBI Special Court in Ernakulam with future consequences in connection with the legal proceedings against the petitioner's client, an accused in an NDPS case. It is further alleged that the threat was to prevent the officer from discharging his official duties.

After receiving disconcerting phone calls from the police, the petitioner moved the High Court seeking to quash the crime. According to him, the present crime was registered as a counter-blast against him merely for exercising his professional duties and asking his client to disclose the custodial violence faced by him. He has also stated in his plea that he is facing threats of implication in false narcotics case.

The plea is moved by Advocate P.T. Sheejish.
