The Madhya Pradesh High Court on Friday (May 22) issued notice on a plea filed by Twisha Sharma's father, challenging the anticipatory bail granted to her mother-in-law, Giribala Singh, in connection with the dowry death case.

The court also issued notice on a plea filed by the State opposing the grant of anticipatory bail to the mother-in-law. 

Twisha Sharma, a 33-year-old woman, was found dead at her matrimonial home in Bhopal on May 12. An FIR has been lodged under BNS Sections 80(2) (dowry death), 85 (cruelty) and 3(5) (common intention) and Sections 3 (giving or taking dowry) and 4 (demanding dowry) of the Dowry Prohibition Act.

The State has also preferred a separate appeal, challenging Giribala's pre-arrest bail.

Solicitor General Tushar Mehta, appearing in the matter submitted before Justice Avanindra Kumar Singh that the trial court granted relief to Singh, "without looking at anything."

"The fact missed by the Trial Court is the position of the accused," Mehta submitted.

Significant to note that Giribala Singh is a retired judge. Mehta added that the trial court order lacked any findings.

As the Court was inclined to issue notice in the matter, Mehta urged that the case be re-notified at the earliest (on Monday), as the investigation is at a crucial stage.

"Kindly make the notice returnable on Monday so that further evidence is not lost. There is a serious apprehension of tampering with evidence," he said.

Accordingly, the matter is now listed on Monday (May 25).
