Twisha Sharma Dowry Death Case | MP High Court Quashes Anticipatory Bail Granted To Mother-In-Law Giribala Singh
The Madhya Pradesh High Court, on Wednesday (May 27), quashed the anticipatory bail granted to retired judge Giribala Singh by the Trial Court in her daughter-in-law Twisha Sharma's alleged dowry death case.
The case is regarding the unfortunate death of a 33-year-old model-actress, Twisha Sharma, who was found hanging in her husband's residence on the night of May 12, within six months of their marriage. Per Twisha's parents, her husband and mother-in-law subject her to cruelty and dowry harassment.
The husband, who is a practising lawyer, had applied for anticipatory bail but was denied the same. He later approached the High Court, but withdrew the petition with permission to surrender before the Trial Court.
The mother-in-law was granted anticipatory bail on May 15, on the grounds that the FIR and WhatsApp chats were directly against her son. Aggrieved, the State as well as Twisha's parents filed the present petitions.
The bench of Justice Devnarayan Mishra, upon examination of the evidence, noted
"there are clear allegations against the respondent and her son. From the WhatsApp chats also, it cannot be said that the allegations are only against Samarth Singh but the trial Court did not consider all these facts".
The court noted that the Trial Court, from the WhatsApp chats, concluded that the allegations were directed towards the husband and not the respondent.
However, upon examination of the case diary, the bench noted that the death was due to antemortem hanging, along with six other injuries. The bench noted that the query report clarified that 'these injuries were not caused by taking out the body from the ligature or carrying out to the hospital'.
The court noted that the witness's statements clearly stated that the respondent and her son were harassing the deceased and pressuring her to abort the pregnancy. Further, the bench noted that the statements also recorded clear allegations against the mother-in-law.
Thus, the bench directed;
"In light of above factual aspects of the case and the allegation levelled against the respondent, the anticipatory bail order dated 15.05.2026...for the offense punishable under Sections 80(2), 85, 3(5) of BNS, 2023 and Sections 3 & 4 of Dowry Prohibition Act, 1961, is hereby quashed".
