Meghalaya High Court Gives State 4 Months To Process Terminal Benefits For Widow Of Employee Who Died Without Receiving Dues
The Meghalaya High Court has directed the State Government to process the release of terminal benefits to the widow of a deceased Public Health Engineering Department employee, who died in 2020 without receiving his retirement dues.
The Court observed that although the employee's superannuation on January 31, 2016, had been acknowledged by the State, there was no material to establish that the authorities had taken positive steps to ascertain his service status after his transfer.
The Court accordingly directed the State authorities to conclude the process for grant of terminal benefits within four months.
Justice H.S. Thangkhiew “In this view of the matter and as the date of superannuation has also been acknowledged, notwithstanding any other intervening circumstances, the writ petition is allowed by directing the respondents to process the case for grant of terminal benefit of the deceased employee, husband of the writ petitioner and to conclude the same within a period of four months from the date of this order.”
The petitioner's husband, C.N. Thapa, had joined the Meghalaya Public Health Engineering (PHE) Department as a Sub-Engineer Grade-II on October 15, 1980. His services were regularised by the Meghalaya Public Service Commission on January 27, 1982, and he was due to retire on January 31, 2016. However, he died on September 3, 2020, without receiving his terminal benefits, including gratuity, leave salary and General Provident Fund (GPF) dues.
Aggrieved by the non-release of the admissible benefits, his wife, Gita Newar, approached the Meghalaya High Court seeking directions for the release of family pension and other terminal benefits under the Meghalaya Civil Services (Pension) Rules, 1983.
The Meghalaya High Court observed that although the deceased employee had handed over charge at Bajengdoba Sub-Division on September 15, 2008, the State had failed to produce any material establishing whether he had subsequently joined his posting at Williamnagar or superannuated from there.
The Court further noted that there was no material to show that the authorities had taken any positive steps to ascertain his service status.
The Court took note of the notification dated December 4, 2015, issued by the Principal Secretary, Government of Meghalaya, acknowledging that the employee was due to retire on January 31, 2016.
Considering the acknowledged date of superannuation, the Court allowed the writ petition and directed the State authorities to process the release of his terminal benefits to his widow within four months.
