While dealing with a plea challenging grant of 100% subsidy on electricity used for running tube-wells so far as 'rich farmers' are concerned, the Punjab and Haryana High Court today asked if it can interfere with State's policy decision.

The Punjab government gives 100% subsidy on electricity used for running tubewell for irrigation purposes to farmers.

Whereas the Haryana government has separate policy under Section 65 of the Electricity Act but doesn't give 100% subsidy.

The plea filed in 2018 by a Punjab resident Hari Chand challenged the benefits so far as wealthy farmers are concerned. It was contended that there should be some bar instead of giving 100% subsidy. However, the bench of Chief Justice Sheel Nagu and Justice Sudhir Singh at the outset asked the Petitioner who are 'rich farmers'.

The counsel submitted that such determination can be made by looking into area of lands held by farmers, their sources from other incomes, etc.

The bench then told the Petitioner that he will have to satisfy "whether it is a policy matter and how far the court can interfere."

During the hearing, the Counsel appearing for the Haryana Government sough to contend that the subsidy given under Section 65 of the Act is "not a burden on tax payers" since the State is giving it from its own money...

"Everything that state gives is from tax payers money", Justice Sudhir Singh remarked and adjourned the plea till April 26.
