Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.
A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar will take up the part-heard matter for further hearing. Senior Advocate Mukul Rohatgi for SIT will continue his arguments today.
On the last occasion, Mr Mukul Rohatgi, appearing on behalf of SIT, vehemently controverted the submissions of the Petitioner that the SIT was trying to shield someone or something. He argued that on the contrary, the details in the Closure Report demonstrate the extent to which the SIT went to in order to conduct the investigation in the matter, keeping in view and often exceeding the mandate of the Supreme Court.
Mr. Rohatgi had also apprised the Court that the Petitioner had made serious allegations against the then Chief Minister of Gujarat with respect to delay in requisitioning of the army. However, after investigation, the SIT found out that, on the contrary, the army was called in within the first three hours of the riots. Replying to the contention, Kapil Sibal noted that he hasn't mentioned about Chief Minister, but if Rohatgi continues reading it, then he will have to deal with the same.

Rohatgi: After I finish, the State Govt will take about an hour. I intend to finish by lunch time.
Rohatgi: Now, the next allegation is about the two ministers. He[TC] has gone allegation wise. What else to do? He has gone allegation wise like SIT.
Bench: The procedure was completed. It was taken to Solah.
Rohatgi: Yes, it was not left on track, it was taken to Solah and handed over. The judge is saying at the end of the day there is no criminal intention.
Bench: Your argument is that what the other side is saying that it has not been considered by Magistrate is not correct.
Bench: The real question by the other side was whether there was malafide intention in the decision. All those reasons have been stated [in TC order].
Rohatgi: So, he applies his own mind also.
Rohatgi: This is his[TC] finding. This allegation is unclear imaginary and false. The decision to conduct post mortem and carrying the body, he[TC] said was justified.
Rohatgi: This allegation is before, your lordship, this was before the SIT and this was before the TC.
Rohatgi: Allegation is bodies were given to Patel, Patel paraded. SIT found bodies were not given to Patel, they were given to police and carried in truck. It reached Solah, kins were haded over bodies from Solah.
Bench: 1st 2 allegations you are done. Either we are not able to follow you or not able to get you. [Go one by one].
Rohatgi: He (TC judgment) concurs with SIT that there is no evidence to show influence of ministers in control room.
