Judges Are Careful In Using AI; We Don't Want AI To Overpower Judicial Process : CJI Surya Kant
While hearing a PIL seeking guidelines to check the misuse of Artificial Intelligence in Courts, Chief Justice of India Surya Kant observed that the judges are very careful in using AI.
The bench comprising CJI Surya Kant and Justice Joymalya Bagchi was hearing a petition seeking the regulation of the 'unregulated' use of generative AI in Court proceedings.
The CJI, objecting to the assumption that there is an 'unregulated use', expressed :
"There is no question of unregulated use by us. I, my brothers and Sisters have spoken on this- that we are using it in a very careful manner. We don't want AI and machine learning to overpower the judicial decision-making process- many times we have highlighted."
Senior Advocate Anupam Lal Das, appearing for the petitioner Karthikeya Rawal, said that there are instances of AI-generated fake precedents being cited by advocates.
The CJI responded that AI tools must have generated fake precedents because advocates appeared to have cited such fictitious case laws somewhere. He cautioned that lawyers, too, must remain alert to the misuse of AI and noted that relying on fabricated material is contrary to their professional responsibility.
The counsel then mentioned the white paper issued by the Supreme Court on the use of AI. He also placed reliance on Kerala High Court's recent policy outlining guiding principles for the responsible use of Artificial Intelligence (AI) tools in the district judiciary in the State.
The CJI said: "You are speaking as if we do not know what is happening in Kerala High Court". The CJI added that he was in touch with the top brass regarding the High Court's policy. He explained to the counsel that such policies require thorough consultations.
The bench told the counsel that the suggestions can be given to the Court on its administrative side. Agreeing, the counsel then sought to withdraw the matter and place suggestions.
The bench dismissed the matter as withdrawn and allowed to place the suggestions accordingly.
The order stated :
"Sr counsel seeks permission to withdraw the matter, and is permitted to withdraw this petition; however, the petitioner is allowed to submit the suggestions to us on the administrative side."
