Kamat : There can be a law prescribing uniforms. For eg, Bar Council can prescribe a dress code for advocates. The point is if the restrictions are compatible with fundamental rights and are reasonable.
Kamat refers to another judgment which holds that what to wear is part of right to privacy and expression.
Justice Dixit : So can tomorrow onwards my brothers say they won't wear the judges' attire?
Justice Dixit notes :AG vociferously objected to the statement of Mr Kamat as regards segregation of any students as stated in the affidavit. He states that such baseless allegations should not be made since they have danger potential in a sensitive society like ours.
Kamat: Irrespective of what is said in the Brown judgement we have Article 14 to protect us.
Kamat says that there are at least 10 Indian judgments which refer to US decision in "Brown v Board of Education".
Justice Dixit says the point is whether it has been adopted and not just referred.
Justice Dixit : I am only recording his submission. Even if he says that the building of High Court should be pulled down, I have to record it, even if I may disagree with it.
AG : Then my statement may also be recorded.
Justice : I will record you statement in Bold letters.
Advocate General again objects to Kamat's submission regarding hijab wearing children are made to sit separately.
AG - Such statements can have far-reaching consequences.
Justice Dixit makes a note to summarize Kamat's arguments.
Kamat : It is my submission that such segregation offends Article 14. Freedom of speech cannot be suppressed inside Court.
Advocate General strongly objects to above statements of Kamat. Says such statements fan feelings.
AG vehemently says - We don't know the facts. Submissions should be limited to law and not politics.
