'Supreme Court Mein Entry Band Kar Denge': SC Warns Petitioner For Repeated PILs To Declare Netaji Won Indian Independence
The Supreme Court on Monday dismissed a public interest litigation filed by one Pinakpani Mohanty seeking a declaration that Netaji Subhash Chandra Bose's Indian National Army (INA) secured India's independence.
A Bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi observed that the petition appeared to be an attempt to gain publicity and noted that a similar public interest litigation filed earlier by the same petitioner had already been rejected.
During the hearing, the Chief Justice orally remarked, "Supreme Court mein entry band kar denge," warning the petitioner who appeared in person.
The petitioner had sought a declaration that Netaji Subhash Chandra Bose be recognised as the "National Son" and that the foundation day of the Indian National Army on October 21, 1943, along with Netaji's birth anniversary on January 23, 1897, be observed as National Days.
Taking note of the repetitive nature of the filings, the Bench directed the Registry not to entertain any writ petition filed by the petitioner claiming to be in the public interest.
The following were the prayers sought in the present petition :
a. To give necessary direction to the concerned Authorities/declare that the activities of all revolutionaries ( who are not following Ahinsha ) and Netaji's I.N.A ( Azad Hind Fauj ) have actually given Independence to India ("Bharat) from britishers in 1947 and to give necessary Direction concerned Authorities/declare that Azad Hind fauj ( Indian National Army ) foundation day that is 21st Oct 1943 to be observed as National Day and tribute that 26,000 soldiers of Netaji's I.N.A who died for Indian Independence.
b. To give necessary direction to concerned Authorities to declassify the actual truth report of Indian Independence in 1947 - how Britishers left India and for what reasons, the role of all Krantikaries ( Revolutionaries ) who are not following Ahinsha including Netaji Azad Hind Fauj, report of the mutiny of the then Indian Soldiers, Navy, Air Force, Army, Civilians in 1946-1947, foreign Countries - Adolf Hitler German Govt., Japan Govt. Italy Govt. others and the report of the then British Prime Minister Mr. Clement Atlee and British Govt.
c. To give necessary direction to the concern authorities/declare that Netaji Subhas Chandra Bose as National son officially and his date of birth 23rd January 1897 to be observed as National Day and his birth place Cuttack Odisha Honored as National Museum and to give necessary direction to the concern authorities/declare that Neerya Arya (The first lady Spy ofI.N.A) as a National Daughter officially and her date ofbirth 5th March 1905 to be observed as National Day.
In 2024, a similar petition filed by the same petitioner, for similar reliefs, was dismissed by the Court.
