Final Acquittal Obliterating Sole Basis Of Dismissal Entitles Police Officer To Reinstatement: HP High Court
The Himachal Pradesh High Court has held that a police officer dismissed from service solely on the basis of a criminal conviction is entitled to reinstatement after the conviction is set aside and he is acquitted in appeal.
The Court observed that once the sole basis for dismissal ceases to exist, the officer's case must be reconsidered in accordance with law.
Justice Jyotsna Rewal Dua remarked that: “The dismissal of the petitioner was based solely on his conviction in the criminal case. Once the conviction has been set aside in appeal and the petitioner has been acquitted, the basis for his dismissal no longer survives.”
The petitioner, Dinesh Kumar, joined the Himachal Pradesh Police as a constable in 1997 and was promoted to Head Constable in 2011. In 2016, he was booked under the Narcotic Drugs and Psychotropic Substances (NDPS) Act and was convicted by the trial court in April 2018, receiving a sentence of 14 years' rigorous imprisonment. He was subsequently dismissed from service in July 2018 on the basis of his conviction.
However, the Himachal Pradesh High Court acquitted him in appeal on October 20, 2023, holding that the prosecution had failed to prove its case beyond reasonable doubt. After his representation seeking reinstatement was rejected by the police authorities in August 2025, he approached the High Court.
The High Court observed that the petitioner's dismissal was based solely on his criminal conviction, which was subsequently set aside in appeal. It found that the police authorities' rejection of his reinstatement request was based on “imaginary facts and nonexistent record,” as no departmental inquiry had independently established his involvement in drug trafficking.
The Court noted that the departmental inquiry had been closed at the time of his dismissal and that, given the passage of nearly eight years, the authorities could not now reopen the proceedings.
Accordingly, it quashed the rejection order and directed the petitioner's reinstatement with consequential benefits, including seniority, notional promotions and salary refixation, along with 50% back wages, to be granted within four weeks.
