Rajasthan High Court Denies Bail To Foreign MBBS Graduates Accused Of Securing Internships With Fake Clearance Certificates
The Rajasthan High Court has refused to grant bail to several foreign MBBS graduates accused of securing mandatory internships in government and private hospitals by using fake Foreign Medical Graduate Examination (FMGE) clearance certificates. [2026 LiveLaw (Raj) 276]
The bench of Justice Ravi Chirania observed, "Though, the petitioners are students, however, their admitted act of using fake certificates of FMGE clearly shows that despite having the professional degrees, they did the above mentioned serious act, which cannot be taken lightly in the given facts and circumstances."
For context, the petitioners had secured the degree of MBBS from foreign countries like Kazakhstan, Georgia, etc. which was not disputed. As per the prescribed procedure, they were required to clear FMGE to be able to obtain mandatory internship, followed by registration with medical council.
It was alleged that the petitioners could not clear FMGE even after multiple attempts, and came in contact with a gang that provided fake clearance certificates. The petitioners used these certificates to get the internships.
When the matter was reported and the investigation started, many of them destroyed their certificate, and withdrew their internship from the concerned Hospital. However, FIR was filed against them and they were arrested.
It was argued on behalf of the petitioners that their conduct was not so serious considering that their status was only that of student at the relevant time, and they did not misuse their degree professionally.
On the contrary, State submitted that the conduct of the petitioners was serious in nature, as they planned to practice as professional doctors based on fake certificates that carried the potential of endangering the life of common people.
It was further argued that the matter was still under investigation and many more persons might be arrested for having such fake certificates. Hence, in light of such serious conduct on part of the petitioners, their bail applications shall not be accepted.
After hearing the contentions, the Court dismissed the bail applications.
