Rajasthan High Court Refuses Bail To 'Myanmar Nationals' Accused Of Trafficking Rohingya Girls Under Guise Of Marriage

Rajasthan High Court denied bail to three men accused of being the residents of Myanmar and illegally importing Rohingya-origin girls to India under the false pretext of solemnizing their marriage and then selling them off.

The division bench of Justice Inderjeet Singh and Justice Bhuwan Goyal observed that taking into account the facts and circumstances of the case, statements of the protected witnesses and the seriousness of the allegations, the rejection of bail had to be upheld.

The Court was hearing criminal appeals filed against the order of the Special Judge (NIA cases) that rejected the bail applications filed by the accused-appellants. It was argued that the appellants were wrongly implicated and were in judicial custody for more than 2 years.

The counsel submitted that statements of protected witnesses were already recorded and conclusion of the trial might take long time.

On the contrary, the appeals were opposed by the State which argued that appellants are residents of Myanmar and in case they are released, there was a possibility of them threatening the victims/complainant, and fleeing from India.

Special Public Prosecutor has opposed the bail pleas and submitted  that the allegations levelled against the accused-appellants are "that they, without any valid passport, illegally imported Rohingya origin girls by deceiving them to solemnize their marriage and thereafter sold them".  

It was further submitted that statement of material witnesses and victims/complainants were yet to be recorded.

In this background, and considering the seriousness of the allegations, the Court observed that it was not just and proper to allow these appeals.

Accordingly, the bails were rejected.
