The Rajasthan High Court has imposed Rs. 1,00,000 costs on the Department of Law and Legal Affairs, the High Court administration, Chief Accounts Officer (Directorate of Estate), and Director (Pension and Pensioners Welfare), for withholding the retirement benefits of a former trial court judge, who retired in 1999.

The division bench of Acting Chief Justice Sanjeev Prakash Sharma and Justice Maneesh Sharma directed the respondents to release the dues within 7 days, with an interest of 9% per annum, to the petitioner who was running in his 80s.

It was argued by the respondents that the petitioner had not paid the house rent, and had kept the house even after his retirement.

However, the Court noted that the Estate Director had written a Letter in 2001, to the Registrar, to deduct the amount of around Rs. 57,000/- from the gratuity and release the remaining amount. Yet, no amount was released even after lapse of more than 25 years.

In this background, while directing immediate release of the benefit, the Court imposed a cost of Rs. 1 lakh on the respondents.

A compliance report has been sought on the next date i.e. July 20, 2026.
