Bombay High Court Grants Interim Relief To Asian Paints, Restrains Competitor From Using Similar Marks

The Bombay High Court has temporaily restrained a rival paint and wall-putty manufacturer from using the marks “ASIANGOLD” and “SUPREME GLOSS” after finding that they infringe Asian Paints' registered trademarks and copyrighted artwork.
A single bench of Justice Sharmila U Deshmukh confirmed an earlier ad-interim injunction on November 18, 2025, noting that manufacturer Vinod Satyaprakashji Mittal had neither appeared despite service nor filed any reply to challenge the court's prima facie findings.
The court recalled its December 10, 2024 order, which had recorded a prima facie case of overall deceptive similarity between the rival marks and held that Mittal's marks and artwork were deceptively and confusingly similar to those of Asian Paints. A subsequent order on July 28, 2025 had granted similar protection on Asian Paints' passing-off claim.
Since Mittal did not contest the proceedings, the court held that the findings in both earlier orders remained unchallenged and therefore confirmed the injunction. It barred him from manufacturing, marketing, distributing or selling wall putty, enamel, paints or similar products using the impugned marks or any mark deceptively similar to Asian Paints' “ASIAN” and “ASIAN PAINTS” trademarks.
The court also prohibited the use of any artwork, colour scheme, layout or trade dress substantially or strikingly similar to Asian Paints' “TRUCARE” wall-putty or “APCOLITE GLOSS” enamel artworks, and restrained Mittal from adopting any trade dress likely to pass off his goods as those of Asian Paints.
