The Delhi High Court has recently directed the Delhi Government to release compensation amount to various victims of the 2020 North-East Delhi riots based on the recommendations of the Claims Commission.

Justice Sachin Datta was dealing with a batch of 20 petitions moved by various victims of the riots seeking compensation in accordance with Delhi Government's “Assistance Scheme for the Help of Riot Victims.” Some of the petitioners seek enhanced compensation.

On January 15, the Court was informed by the counsel appearing for the petitioners that the North East Riot Delhi Commission had made recommendations qua the claims in respect of 14 petitions out of batch.

It was also submitted that although the amount assessed and recommended by the North East Riot Delhi Commission was a fraction of what the petitioners were entitled to, directions must be issued to Delhi Government for release of the recommended amount at the earliest.

As the request was not opposed by Delhi Government's counsel, the Court directed:

“Accordingly, the respondent no.2 is directed to release the amount recommended by the North East Riot Delhi Commission qua the petitioners in the present batch of cases.”

The Court added that the release of the amount shall be without the rights and contentions of the petitioners in the batch of pleas.

The matter will now be heard on May 29.

The North East Delhi Riots Claims Commission was set up for providing compensation to victims of the communal violence that took place in the national capital in February 2020. It was inaugurated in November 2020 by Supreme Court Judge, Justice Surya Kant.

Communal clashes had broken out in northeast Delhi on February 24, 2020, after violence between citizenship law supporters and protesters spiralled out of control. At least 53 people died and around 200 were injured during the violence.

About 750 FIRs were registered over the riots, one of which is the UAPA case alleging a larger conspiracy in committing the violence.
