The Punjab & Haryana High Court has directed a visa fraud accused, seeking quashing of an FIR on the basis of compromise, to publish a detailed public notice disclosing his criminal antecedents.
Justice Alok Jain said, “Having considered the nature of the allegations, the material on record and the criminal antecedents of the petitioner, this Court is of the view that allegations of fraud relating to overseas placement, preparation of fake documents and visas process, are serious in nature, which impacted many innocent lives, who wish to settle abroad and paid hefty amount on such visa process. Moreover, the petitioner's involvement in several other criminal cases cannot be dealt lightly, therefore, before considering the prayer for quashing of the FIR on the basis of compromise, it is necessary that the public is made aware of the petitioner's antecedents.”
The Court took on record the State's reply filed through an affidavit of the Assistant Commissioner of Police, Jalandhar. While noting submissions that the dispute was monetary and partially settled, and that the private respondents did not deny the compromise, the Court found the allegations, pertaining to fraudulent visa processing and fake documentation, grave in nature.
Highlighting the petitioner's involvement in multiple criminal cases, the Court held that such conduct cannot be treated lightly.
It directed the petitioner to publish, within 15 days, notices in at least five widely circulated newspapers (including two Punjabi dailies), detailing all FIRs against him, including settled cases involving similar fraud.
“It is apposite to further direct that such publication shall be of more than 6 font size,” the Court added.
Compliance is to be supported by affidavit and placed on record before the next hearing on August 31, 2026.
