Rajasthan High Court Directs State To Comply With Asaram's 20-Day Parole Order
The Rajasthan High Court has directed the State to comply with its order dated August 3 by which rape-convict, Asaram, was granted a 20-day parole, opining that rejection of his application for emergent parole by the Gujarat High Court had no adverse consequences on State's obligations to comply with the order of this Court.
The division bench of Dr. Justice Nupur Bhati and Justice Sanjeet Purohit was hearing an application seeking directions to the State to comply with the order that granted parole to the convict.
It was the case of the Additional Advocate General that while issuing that order, the division bench had observed that if there was any other criminal case registered against the applicant in other State, the same law shall take its own course.
In this light, as submitted, the State refrained from releasing the applicant, since he was convicted in Gujarat too, and was obligated to file an appropriate application before the Gujarat High Court. Since his application for emergent parole was rejected by the Gujarat High Court, the State could not release him in the present matter.
After hearing the contentions, the Court opined that there was no legal impediment, arising from criminal proceedings outside Rajasthan, that could operate to nullify or suspend the effect of the order dated August 3, 2026.
“The entitlement to emergent parole is governed by distinct statutory and rule based provisions and cannot, by itself, be construed as adversely affecting the obligation to comply with the order dated 03.08.2026…In the aforesaid circumstances, there is no iota of doubt that the order dated 03.08.2026 has to be complied with.”
Accordingly, the State was obligated to give effect to the order, it held.
