Rajasthan High Court Stays BSc Nursing Counselling For Academic Year 2025-26 Until Further Orders

Rajasthan High Court has stayed the operation of the order of the single bench that allowed the Deepshikha Kala Sansthan (Regional Nursing College) to participate in the counselling for B.Sc. Nursing course for the academic session 2025-26 without having a valid No Objection Certificate and affiliation from the State Government and Rajasthan University of Health Sciences (“RUHS”).
While staying the entire counseling for the B.Sc. Nursing Course for the academic year 2025-26 until further orders the division bench of Dr. Justice Pushpendra Singh Bhati and Justice Bipin Gupta observed that ordinarily the Court would have hesitated, however, the order was passed to prevent deviations in the Nursing Courses and avoid creation of conflicting rights.
The Court was hearing a special appeal as well as a stay application against an interim order of the single bench directing RUHS to permit the College to participate in the counselling for 50 seats.
The College had filed a writ petition after being aggrieved with non-grant of NOC by the State Government, seeking directions to RUHS to provide affiliation and allowing participation in counselling.
It was argued by RUHS that as per Ordinance 80 of RUHS, NOC was required by a college for getting its affiliation. In its absence, it was not legally permissible for the College to undertake any nursing course.
In this light, it was sought that the counselling be stopped to avoid any discrepancies at this stage, without finalizing the NOCs.
After hearing the contentions, the Court stayed the counselling for the B.Sc Nursing Course for the academic year 2025-26 until further orders, and directed the State to expeditiously address the NOCs, preferably within 2 weeks.
The matter was listed after two weeks.
