 Allahabad High Court on Thursday (December 18) granted interim bail to Vibhor Rana booked for alleged illegal sale of Phensedyl cough syrup on ground that he was not named in the FIR, his name had come out only in the confessional statements of co-accused and no recovery had been made from him during search.

Applicant was allegedly involved in facilitating the illegal sale of Phensedyl cough syrup by using the bank IDs and passwords of their employees. During investigation, it was also found that the applicant along with other accused was involved in illegal smuggling of the cough syrup in various parts of India and even in Bangladesh. Accordingly, Case Crime No.182 of 2024, under sections 420, 467, 468, 471, 34, 120(B), 201 IPC was registered against him.

Bail application was made on grounds that no recovery had been made from the applicant and he was being implicated based solely on the statement of other accused. It was also pleaded that the Phensedyl cough syrup was not a narcotic drug under the NDPS Act.

It was also pleaded that the co-accused from whose custody the cough syrup was actually recovered, were already been enlarged on bail. Claiming parity, applicant sought bail.

Justice Karunesh Singh Pawar held

Upon due consideration of the bail order granted to co-accused Shailendra Arya, the bail orders passed in favour of other co-accused by the Coordinate Bench of this Court, the judgment of the Hon'ble Supreme Court in Ashok Kumar Sharma (supra), the judgment in the case of Vibhor Rana (supra), the material available on record, and the fact that the applicant is not named in the FIR and his name has surfaced only in the confessional statements of co- accused Bittu Kumar and Sachin Kumar, coupled with the absence of any recovery from the applicant, who has been in custody since 13.11.2025, and the undertaking given that he shall not leave Lucknow during the period of bail, this Court finds it to be a fit case for granting interim bail to the applicant.”

The Court has listed the case again on 5th January, 2026.
