The Chief Secretary of Haryana has submitted before the Punjab & Haryana High Court today, that the State has approved setting up of Transgender Protection Cell at State level as well as District level in Haryana.

"State counsel, on the basis of affidavit of Chief Secretary, Haryana, filed in the Court today, submits that by passing the speaking order dated 12.09.2023, Govt. of Haryana has granted approval and sent the proposal to the Department regarding setting up of Transgender Protection Cell at State level and District Level," noted the bench of Justice Arvind Singh Sangwan.

The Court was hearing contempt plea filed by Dhananjay Chauhan who belongs to the transgender community, through Advocate Maninderjit Singh. It was submitted that Transgender Persons (Protection of Rights) Rules, 2020 and Rule (5) therein provide for the mandatory set up of "Transgender Protection Cell" under the charge of the Director General of Police in the state and District Magistrate in each district to monitor cases of offences against Transgender Persons and to ensure timely registration, investigation and prosecution of offences.

Chauhan further submitted that when the protection cell was not formed by the government then she had filed a PIL in 2022 wherein the AAG, Haryana had submitted that action will be taken expeditiously and considering the submission the petition was disposed of.

However, no decision was taken by the Government for setting up of Transgender Protection Cell, submitted the petitioner.

After considering the affidavit submitted by AAG today, the Court disposed of the petition.
