The Calcutta High Court has directed the Raniganj Police authorities to file a report disclosing the basis for detaining a man, allegedly suspected to be a Bangladeshi national, since August 8, 2026.
The Court took exception to the fact that the man had remained in police detention for over a month and was being interrogated by the police authorities themselves instead of being referred to the Foreigners Regional Registration Office (FRRO) immediately.
Justice Saugata Bhattacharya while hearing the matter, directed the police authorities to explain the circumstances in which steps were taken against the petitioner and why he had continued to remain in police detention since August 8.
The Court directed that the report be filed within 10 days.
" A report is to be filed disclosing as to why steps taken against the petitioner and why he is being detained by the police authorities since 8th August," the Court observed.
The Court also questioned the rationale behind initiating proceedings against persons who may have crossed the India-Bangladesh border several decades ago, while raising concerns over the manner in which the petitioner was being detained.
"You will find in 70s and 80s many thousands of people crossed the border. Now what will you do? Start proceedings against every body? And this fashion? By violating human rights? Detaining him from August… today is the middle of September," the Court remarked to the state counsel after dictating the order.
