Excessive Sweating Of Palm Not Grounds To Declare Candidate Medically Unfit For Appointment In CAPF: Calcutta High Court
The Calcutta High Court has held that palmar hyperhidrosis (excessive sweating of palms) is not a valid ground to declare a candidate medically unfit for appointment as Constable (G.D.) in the Central Armed Police Forces (CAPFs).
The Court observed that the recruitment authorities failed to demonstrate any specific provision under the applicable medical guidelines which disqualifies a candidate on account of palmar hyperhidrosis.
Justice Saugata Bhattacharyya noted that Clause 6(16) of the Recruitment Medical Examination Guidelines, 2015—relating to mental or nervous instability—was wrongly invoked, as no conclusive medical evidence was produced to establish that the petitioner's condition was linked to such instability.
The Court found that the decision to declare the petitioner unfit was based on surmise and conjecture.
Accordingly, the authorities were directed to treat the petitioner as medically fit and to take steps for his appointment as Constable (G.D.) within two months, subject to the fulfilment of other eligibility conditions.
