The Rajasthan High Court sought response from Bar Council of India (BCI), in a matter wherein a advocate–practicing for 13 years, alleged that despite clearing the All India Bar Examination (AIBE) in 2012, he has been denied certificate of practice for not clearing AIBE within the stipulated time.

It was the case of the petitioner, that he was a regularly practicing advocate and an active member of Bar. He was issued his enrollment certificate in October 2012, and had cleared AIBE in 2012, post which he was allotted his enrollment number.

However, in a list issued by the BCI in 2022, instead of his name appearing in the list of successful candidates, it appeared in the list of advocates who had not cleated AIBE within the stipulated time as per the AIBE Rules 2010 wherein it was mandatory to clear the exam before issuance of certificate of practice.

Subsequently, as per a communication published in 2025, certificate of practice was refused to be issued to the petitioner. Hence, petition was moved before the Court.

After hearing the contention, Justice Sameer Jain issued notice to BCI and asked it to file reply in the matter.

"It is also directed that respondent No. 2 shall remain present in the Court in person or via VC to explain the matter along with the relevant record, on the next date of hearing," the court said. The matter has been listed for September 9, 2025.
