A PIL has been filed in the Bombay High Court seeking to implead actor Shah Rukh Khan as an accused in the FIR filed by CBI against former NCB Zonal Director Sameer Wankhede and five others regarding the arrest of Aryan Khan in 2021. The PIL will be heard on June 20, 2023.

As per the plea Wankhede was charged by CBI under sections 7, 7A and 12 of the Prevention of Corruption Act for accepting a bribe of Rs 50 lakhs to favour Aryan, Khan's son.

Since Section 12 of the PC Act provides for the prosecution and punishment of the person giving the bribe as well, Shah Rukh Khan and his son Aryan should be arraigned as accused for giving bribe to Sameer Wankhede through co-accused KP Gosavi, the plea adds.

“As per Section 12 of the Prevention of Corruption Act the person giving bribe is also accused of abetment of corruption and liable for prosecution and punishment,” it states.

It further seeks the transfer of investigation from the CBI to a Special Investigations Team and action against Mumbai Police Officials who gave a clean chit to Wankhede in another complaint. “The prosecution of offender is an obligation of the state,” the petition adds citing an SC judgement.

The petition has been filed by one Rashid Khan Pathan who claims to be a human rights activist. He claims the non-inditement of Shah Rukh Khan is a “lapse on the part of the CBI regarding the manner in which the investigation is being conducted.”
