The Kerala High Court has declined to impose death sentence upon Nino Mathew for the double murder of his accomplice and lover Anu Shanthi's three year old daughter and mother-in-law.

The Division Bench comprising Justice P.B. Suresh Kumar and Justice Johnson John converted the death sentence imposed upon Nino Mathew to Life Imprisonment and ordered that he shall not be entitled to remission for a period of 25 years. The Court dismissed the appeal preferred by Anu Shanthi and confirmed the life sentence imposed upon her by the Sessions Court.

"So far as the first accused is concerned, the death sentence on first accused under Section 302 of the IPC is converted to imprisonment for life and it made clear that the first accused shall not be entitled for any remisison for a period of 25 years. "

Nino Mathew was awarded death sentence and Anu Shanthi was awarded life sentence by the Sessions Court, Thiruvananthapuram for committing the offence of murder under Section 302 of the IPC.

The Court was considering the appeals filed by Nino Mathew and Anu Shanthi against their conviction and Nino Mathew's death sentence reference.

The duo came in a relationship while working together at an IT company in Technopark, Thiruvananthapuram. They have been convicted for conspiracy and murder of Anu Shanthi's three year old daughter and mother-in-law in April 2014.

Based on the orders of the Court, Project 39 A of the National University of Delhi conducted a mitigation investigation before declining to impose the death sentence imposed upon Nino Mathew.
