    A Delhi Court recently pulled up the Delhi Police and the special public prosecutor for their “insensitive approach” in failing to file on time a calendar of evidence and supplementary chargesheet in a case concerning the 2020 North East Delhi riots.

    Additional Sessions Judge Pulastya Pramachala of Karkardooma Courts granted last opportunity to the prosecution for complying with its directions to file the documents and adjourned the matter to July 15 subject to cost of Rs. 2000 to be paid to each accused by the prosecution.

    “This is again a disturbing scenario whether case is being delayed on account of insensitive approach of representatives of the prosecution. Whether the calendar of evidence is to be prepared by IO solely or by ld. Special PP along with IO, it is something between them and not for interference by this court. By passing bucks on each other, prosecution cannot get absolved of its responsibility,” the court said.

    The FIR 98 of 2020 was registered in Dayalpur police station under sections 147, 148, 149, 380, 454, 427, 436 and 120B of Indian Penal Code, 1860.

    The accused in the FIR are Shah Alam, Irfan, Habib Ahmed, Rashid Saifi, Mohd. Shadan and Azhar, Salim. All of them have been enlarged bail in the case.

    On March 20, the court had directed the prosecution to file a calendar of evidence with specific particulars. As per the request of prosecution, it also was given time to file supplementary chargesheet.

    However, the judge said that the neither supplementary chargesheet nor calendar of evidence was filed by the prosecution.

    Special Public Prosecutor submitted that no one from the Delhi Police had contacted him for the purpose of preparing the documents and that he had informed the concerned SHO and IO.

    “This would be last opportunity to comply with these directions and case is adjourned, subject to cost of Rs.2000/- to be paid to each accused by the prosecution. Copy of order be sent to ld. Commissioner of Police for strict compliance of directions of the court and to ensure payment of cost by next date of hearing,” the court said.
