Plea In Delhi High Court Alleges ‘Large Scale Rigging’ In LLB, LLM Entrance Exams Of Delhi University

A petition has been filed before the Delhi High Court alleging “large scale rigging”, question paper leak and manipulation of final results in LLB and LLM entrance exams for academic session of 2022. Justice Purushaindra Kumar Kaurav directed the varsity and NTA to seek instructions in the matter, while listing it for hearing on March 22. However, the court has not yet issued a formal notice in the case.“Before issuing notice, this court finds it appropriate to direct the University of Delhi/respondent No. 1 and National Testing Agency/respondent No. 2 to seek instructions,” the court said.The plea has been moved by 19 candidates who participated in the online entrance examination test for admissions to the courses of LLB and LLM offered by the varsity but were disqualified in the result declared on December 12. It is their case that the entrance test was a “planned scam between officials and few scammers who enjoy privilege through political influence within the administration” which included leaking of question paper and management of exam centre that resulted in “unprecedented rise of cut-offs”.The plea thus seeks an independent, credible and impartial investigation into the alleged incidents of misconduct and scam against more than 300 identified students by a Special Investigation Team.It also seeks a direction on DU and NTA to assess the reason for inflated cut-offs and to identify the candidates who were unduly benefited by use of any kind of unfair means in the examination. The plea also seeks compensation to the “victims of the scam by allowing them their deserved place.”The petitioners have submitted that no concrete steps have been taken by the varsity’s administration even after representations were made by students along with relevant proofs. “The so called law enforcement agency, Delhi police has acted like deaf and blind when students reached them. The unsympathetic attitude of Delhi Police can be measured by the act that they even refused to file the F.I.R which is basic right given to any person in India and also held mandatory procedure in Lalita Kumari v Government of Uttar Pradesh & Ors,” the plea states. It adds that the conduct of the police as well as University’s administration is manifestly arbitrary and mala fide, affecting the petitioners’ right to education, right to equality and right to justice, as also Articles 14 and 21 of the Constitution of India.
