[LIVE UPDATES] SC Hearing On Plea Against Sudarshan News TV's "UPSC Jihad" Show

Justice Chandrachud: We have asked them to place a copy of the report before this court, thereafter if it becomes necessary for you to impugn it, you can do so.

Justice Chandrachud: We'll see, we'll see.

The bench changes the date the matter to 5th October at 2 PM.

Advocate Ravi Sharma for Madhukishwar seeks time to make submissions for intervening the present case:-

"My comments have been used for justifying hate speech, i may be given 15minutes to make submissions."

The notice shall be dealt with in accordance with law and Central Govt. will submit a report to this court indicating outcome of this notice.

The interim orders to continue.

Justice Chandrachud dictates order:

"During the course of the hearing, SG has submitted that the central govt. has in exercise of power by 20(3) of Cable TV Act 1995 has issued a notice to show cause to SudarshanNewsTV today. This is stated to be returnable on 28th sept...."

"We are of the view that since the notice of the show cause has been issued, it would be appropriate to list the case for further hearing before this court on Oct 1

Chaudhari: If we are aggrieved by an order and it is antithetical to what is prayed for here, then we may be heard. If Government gives us a chance, that'll be fine.

SG: Section 21 under Act is not a power which puts forth a lis between parties. It is a power of the Executive.

SG: This is an exercise of executive powers regarding contents of a particular show and there is an affected party.

Justice Chandrachud: Are you pressing Mr. Chaudhari that you be heard before the govt. Authority?

SG says that this will formulate a precedent.

Justice Chandrachud: If it were to be heard only in the facts of this case?

SG: Govt. may take the call of hearing anyone and if they feel it is necessary to be heard, they may do so, without a specific direction by My lords.

Justice Joseph asks SG: If someone makes a complaint, would it be totally illegal for you to hear them, even if we take into account the principles of natural justice?

SG: I am not saying that, but I wouldn't want to concede so something that becomes a norm.

SG: No, there will be no departure from the statutory framework.

Justice Chandrachud: Okay fair enough.
