    The Supreme Court will hear at 1 PM the petition filed by the Central Government challenging the show-cause notice issued by the Delhi High Court yesterday for contempt action for failure to supply 700 MT per day oxygen to the National Capital Territory of Delhi.

    A bench led by Justice DY Chandrachud is hearing the matter.

    The petition was mentioned before the Chief Justice of India Justice NV Ramana by the Solicitor General Tushar Mehta today morning. The CJI assigned the matter to Justice Chandrachud's bench.

      Justice Shah: At present, daily requirements need to be met. 


      Justice Chandrachud: Brother Shah is giving me serious threats that he wants to part with me tomorrow. He needs to take care of his parents.

      Justice Chandrachud: This contempt proceedings and all is different. We want some action on the ground. We are sitting tomorrow as well. I will dictate an order right now. 


      Justice Shah: If the daily need is not being met, how can there be a buffer stock ?

      Justice Chandrachud: We will dictate a short order right now, and we will give you time till 4 or 5PM today to come back and tell us how will you ensure the 700MT is supplied. We will record that. We will take a bullet point in the afternoon and we will take that on record.

      Justice Shah: You also have to tell us about the tank supply. Some study should be there on supply, demand and procurement. for supply Some other states may be deprived.

      Justice Chandrachud: We will take a break of half an hour and you can then answer us on this. How much will you go to by midnight today and how will you achieve 700 ? We don’t accept this 555 for today and tomorrow.

      Justice Chandrachud: So far as actual procurement, we want to be ensured that 700 MT is available for Delhi so that it takes away the current sting in society. Until this exercise is complete, we need to ensure Delhi has holding capacity of 700.

      Justice Chandrachud: Actual availability of oxygen. The procurement. I find that there is a problem on the first. You have computed this on a rough and ready oxygen per bed formula. Planning for optimising for beds in Delhi, we will try and extrapolate from Bombay.

      Justice Chandrachud: We got the point. There are three distinct things. 1) Methodology for computing requirement for a particular State or UT. 2) Planning for management of resources of State/UT, which requires us to optimise the use of oxygen and efficiency of supply chain.

      SG: I straight away say that this figure or bed-capacity wise allocation is static. There is limited capacity of oxygen too. If Mr Gupta asks for oxygen of 700, we can give 800, but it can become 1000. Sometimes 800 can become 500.
