    Mediation has developed into a mainstream dispute resolution process for commercial disputes. Business and commercial mediation has developed into a sophisticated form of managed negotiation, where the resolution has to satisfy the needs and interests of the parties and help to build great relationships. Lawyers are upskilling in areas that technology can’t take over, such as mediation, negotiation and problem-solving. And research has found that commercial clients show a preference for mediators who can get them resolutions fast and in a business friendly manner. This is possible with the skills of an excellent mediator.

    Training in mediation is life and career changing. So say those who have done so. Mastering mediation skills will make you a better lawyer. You will learn new ways to interact with clients, colleagues and adversaries and can offer your clients a better service.

    The importance of private mediation in international business dispute resolution has become even more pertinent after the United Nations Convention on International Settlement Agreements Resulting from Mediation, 2019 (Singapore Convention), w.e.f 07 August 2019, in which India is also a signatory, among other 55 countries. Now settlement agreements arrived at by way of mediation becomes enforceable like an arbitral award as per the Convention. The Convention does not apply to court-annexed mediations, making the importance of private mediations in cross-border business disputes highly recommended. The convention has opened the door to a new global profession as an International Mediator and highlighted the importance of accreditation for mediators in global practice. Considering the importance of mediation and its relevance in international business, India is also in the process of enacting a new Mediation Law.

    Have you ever thought about entering the field of Professional Mediation? You have to be a person with a good repute and integrity with a sense of fairness and above all a passion for conflict resolution. There is no specific academic qualification for a mediator. You may be a professional, like lawyer, retired judicial officer, engineer, company secretary, chartered accountant, clinical psychologist etc. You may also be a retired teacher, banker or a housewife. You can start a new profession as a Mediator and start your professional practice from the comfort of your office or home.

    MEDIATOR TRAINING PROGRAM
    Indian Institute of Arbitration & Mediation (IIAM) announces its Professional Mediator Training Program, which is the only APCAM Certified Training Program in India.
    Mode: The program will be conducted online extending 8 days (55 hours).
    Date: 15th February to Thursday 23rd February, 2023
    Time:  9.30 am to 5.30 pm.

    The program will enhance the understanding and ability to negotiate and resolve conflicts, as well as provide a solid foundation in the processes of a negotiator and mediator. The training covers the basic foundations for effective negotiation, understanding the bargaining style, setting goals and nurturing relationships critical to negotiation success. The training explores underlying negotiation orientations and strategies and how they are confronted and employed by mediators.

    The program focuses on the structure, process, technique and goals of mediation process and the skills and preparation mediators use to aid parties in overcoming barriers to dispute resolution. The training also gives emphasis on the code and ethical standards of mediation. Experienced and highly knowledgeable trainers introduce you to the theory and concepts of mediation and provide participants with the opportunity to practice this structured dispute resolution process through a series of interactive presentations, role play simulations, real life case studies and discussions, making them effective negotiators and skilled mediators.

    As per IIAM Mediator Accreditation System, a candidate having successfully completed the Training Program is categorised as a Certified Commercial Mediator and will be eligible for empanelment as IIAM Mediator and also under the Peacegate App as a mediator attached with a Centre or as an online mediator, subject to the norms of empanelment. By empanelling as an online mediator, the candidate can enlarge his jurisdiction throughout India.

    By completing this unique program, IIAM will assist the candidate to start his professional mediation practice through IIAM Affiliation. The candidate can start an IIAM Affiliated Mediation Centre (AMC) or can have own space to conduct mediation, as an IIAM Approved Mediation Access Point (AMAP). The AMC or the AMAP and Mediator’s profile will be integrated in the App for availing mediation service by users.

    The entire Administrative back up service will be given by IIAM by providing virtual office, assisting and guiding on all mediations through the Peacegate App. By becoming affiliated with IIAM, the uniform IIAM mediation standard, quality and competency services will apply giving credibility to your mediation practice.

    Being an APCAM Certified Training Program, the participant will also be eligible to apply for accreditation under the APCAM Accreditation norms, so that the participant would be empanelled in APCAM Centres (Asia Pacific Centre for Arbitration & Mediation | www.apcam.asia). APCAM, which is the only international centre having its presence in 8 countries, promote cross-border mediation and arbitration and help the business community to resolve their international commercial and business disputes by mediation or arbitration under a single set of Mediation and Arbitration Rules and with a uniform fee structure.

    The Mediator can upgrade to various certification levels leading APCAM International Certified Mediator under the IIAM/APCAM Qualifying Assessment Programs (QAP).
