    The Central Board of Indirect Taxes and Customs (CBIC) has issued a clarification on the extended timelines for GST compliance.

    The CBIC has issued the notification dated 28.09.2022 by which it appointed 01.10.2022 as the date on which the provisions of sections 100 to 114, except clause (c) of section 110 and section 111, of the Finance Act, 2022, shall come into force.

    Section 100(b) of the Finance Act of 2022 deals with claiming ITC in the return for any invoice or debit note.

    Section 102 of the Finance Act, 2022, relates to the declaration of the details of credit notes in the return.

    Section 103(c) of the Finance Act of 2022 addresses the rectification of particulars in outward supply details.

    Section 105(c) of the Finance Act, 2022, relates to the rectification of particulars furnished in a return.

    Section 112 of the Finance Act, 2022, relates to the rectification of particulars in the statement furnished by a TCS operator.

    The deadline for compliance in relation to a specific fiscal year has been extended and set at November 30th of the following fiscal year, or the filing of the relevant annual return, whichever is earlier.

    There have been questions about whether the extended deadlines only apply to compliance for FY 2022–23 or whether they also apply to compliance for FY 2021–22.

    The question of whether the deadlines for compliance are extended to the date of filing the return for the month of November 2022 or if they can be completed in a return or statement filed or provided up until the 30th of November 2022 has also been raised.

    The CBIC clarified that the extended timelines for compliance are applicable to the compliances for FY 2021–22 onwards. The compliance in respect of a financial year can be carried out in the relevant return or the statement filed upto November 30th, the next financial year, or the date of furnishing the annual return for the financial year, whichever is earlier. No extension of the due date of filing a monthly return for the month of October (due in November) or the due date of filing a quarterly return for the quarter ending September has been made vide the amendments in the CGST Act, 2017.
