'Instigating Youth To Wage War': PIL In Allahabad HC Seeks NIA-ED Probe Against Abhijit Dipke, Blocking Of 'Cockroach Janta Party'

A Criminal Public Interest Litigation (PIL) plea has been moved before the Allahabad High Court (Lucknow Bench) seeking a multi-agency Probe by the National Investigation Agency and the Enforcement Directorate against Abhijit Dipke, the founder of the 'Cockroach Janata Party'.

The PIL plea has been moved by Karnataka BJP worker S. Vignesh Shishir. He has recently been in the news for filing multiple petitions against Rahul Gandhi, including pleas for a probe into his alleged disproportionate assets and an FIR alleging that he holds British citizenship.

In the present PIL plea, Shishir also seeks a direction for the permanent suspension, disabling, and blocking of all social media accounts, pages, channels, groups, handles and profiles operating under or associated with the nomenclature "Cockroach Janta Party".

The plea alleges that this "engineered digital campaign", which emerged following CJI Surya Kant's remarks during Supreme Court proceedings, has been designed to target the country's youth, incite public disorder and provoke disaffection against the lawfully established Government of India.

According to the plea, subversive and anti-national elements weaponized CJI's oral observations by extracting and disseminating truncated video clips of the live-streamed proceedings across various social media platforms.

According to the petition, Dipke is orchestrating a "digital information war" from an undisclosed US location, using his unregistered 'Cockroach Janta Party' to trigger widespread unrest within Indian territory.

The plea levels serious accusations of political and foreign collusion, alleging that Dipke is an active member of the Aam Aadmi Party and has close ties with senior functionaries of the Party, including Manish Sisodia. The plea further claims the invisible hands of former Delhi CM Arvind Kejriwal are behind Dipke's activities.

The petitioner alleges the involvement of foreign deep state entities in this entire campaign as he claims that over Rs 500 crore has changed hands through cryptocurrency and hawala channels.

The plea also draws alleged connections between Dipke and figures like Dhruv Rathee, Arpit Sharma, former US Assistant Secretary of State Donald Lu and Pakistani terror operatives in the Kashmir Valley.

"…this Abhijit Dipke is also closely associated with Pakistani Terror Operatives and outfits in Kashmir Valley Previously since 2019 and several complaints about his anti-national activities are filed with Pune City Police Commissioner Office in the Year-2019 itself. It is necessary to note that there is a plan to create the Youth of the Country as enemy of the Govt of India like how it was done in Nepal, Bangladesh and other foreign nations by Foreign Deep State Entities in USA, Turkey and Pakistan and now they have started ſunctioning India behind the nomenclature "Cockroach Janta Party," the plea states.

Consequently, the plea states that this coordinated campaign poses an existential threat to domestic stability and amounts to waging war against the country.

Against this backdrop, the petitioner seeks immediate registration of a Regular Case (RC) and an Enforcement Case Information Report (ECIR) against Dipke, seeking a probe into his alleged activities.

The plea argues that stringent provisions under the Bharatiya Nyaya Sanhita (BNS), the Unlawful Activities (Prevention) Act (UAPA), the National Security Act (NSA), the Prevention of Money Laundering Act (PMLA) and the Foreign Contribution (Regulation) Act (FCRA) must be invoked against Dipke.

To ensure a comprehensive probe, Shishir has also prayed the High Court to constitute a Joint Investigation Team comprising senior officers from the Intelligence Bureau, the Research and Analysis Wing, Military Intelligence, the NIA and the ED.

Furthermore, the petition seeks the issuance of a Look-Out Circular against Dipke to prevent his entry into India, as well as the initiation of diplomatic correspondence to secure his extradition from the United States.

Additionally, the plea prays for a direction to the Ministry of Electronics and Information Technology to deploy AI-enabled detection mechanisms to block associated digital footprints.

It also prays for a direction to the major Social Media intermediaries to preserve crucial electronic evidence, including geographic metadata and IP logs, before the accounts are permanently disabled.
