Cauvery: SC Reserves Order On Maintainability Of Appeals By TN, Karnataka

The Supreme Court today reserved its order on maintainability of appeals filed by Karnataka, Tamil Nadu and Kerala against the 2007 award of the Cauvery Water Dispute Tribunal (CWDT). Judgement reserved.“Interim order of October 18 to continue till further orders”, a bench of Justices Dipak Misra, Amitava Roy and A M Khanwilkar said.All parties have been asked to file their written submissions by October 24 after which the court said, it would pass the orderAttorney General Mukul Rohatgi appearing for Centre raised preliminary objection claiming that “the CWDT award amounted to a final decree in the dispute and the apex court had no jurisdiction to hear appeals against the award of the tribunal”.Continuing its argument, Karnataka today said that “appeals filed by the state against the award of the tribunal was maintainable”.Jurist Fali S Nariman, appearing for Karnataka, said the “Supreme Court had the jurisdiction to adjudicate the appeals filed by the state against the award of tribunal”.Senior advocate Shekhar Naphade, appearing for Tamil Nadu, also contended that the appeals were maintainable and no statute can take away the powers of the apex court.Section 6(2) of Inter-state Water Disputes Act, 1956 cannot oust Supreme Court's constitutional appellate powers given under Article 136 of the Constitution, Naphade said.Similarly, Kerala also supported the stand of Karnataka and said that the appeals were maintainable. However, Puducherry supported the stand of the Centre that the appeals filed by Karnataka, Tamil Nadu and Kerala are not maintainable.The Supreme Court has yesterday agreed to hear if the appeals filed through special leave against the 2007 Cauvery Water Disputes Tribunal by Karnataka, Tamil Nadu and Kerala are maintainable.The centre and union territory Puducherry have opposed the court’s jurisdiction to hear cases concerning interstate water disputes, while Karnataka and Tamil Nadu in a rare unison on the Cauvery issue agree that the appeals must be heard by the court.Attorney General Mukul Rohatgi argued that under Articles 32, 131, 136 and 262 of the Constitution and the Interstate River Water Disputes Act, 1956- the Supreme Court’s jurisdiction on water disputes is completely ousted.“The moment the issue becomes a water dispute between the states, the court cannot entertain it. Only if relief is outside of use, distribution of water- the Supreme Court can sit in appeal,” he told a three judge bench of justices Dipak Misra, Amitava Roy and AM Khanwilkar.Meanwhile, the court asked Karnataka to continue to comply with the interim order to release 2000 cusecs of Cauvery water per day to Tamil Nadu. It also took into record the report filed by the court appointed G.S. Jha committee that was asked to look into the ground realties in the Cauvery basin.The interim order is to be continued even the technical committee did not suggest a quantum of water that is to be released. After Rohatgi vehemently disagreed with the state’s stand on the maintainability of the appeals, Fali Nariman, Karnataka’s senior advocate argued. Nariman said that the purpose of Article 262 is not to exclude the court’s jurisdiction but to provide for a framework for a certain class of disputes such as water disputes. “Artcile 131 clearly states that states are allowed to move no court but the Supreme Court for interstate disputes- whatever the nature of such disputes might be,” he said.Justice Misra also asked the Attorney General what the course of action must be if the court’s jurisdiction is opposed when a tribunal passes an award violating principles of natural justice. To this, Rohatgi said that law has to achieve finality at some level and court cannot deal with the issue. In spite of the centre’s arguments, the court in its order stated that it we intend to adjudicate the maintainability of the appeals which have been preferred by special leave under Article 136 of the Constitution first. In its parting note, the court made a repeated appeal for peace in the states. “we are compelled to reiterate our earlier order in which we had expressed with certitude that the Executive of both the States shall see to it that the peace and harmony be maintained in both the States and citizens do not become law unto themselves.”This article has been made possible because of financial support from Independent and Public-Spirited Media Foundation.
